Fifth Circuit Survey: Civil Rights Classes
In the 2001-2002 term, the Fifth Circuit considered and decided thirty four cases related to civil rights issues. This article serves to survey and summarize those cases. Its purpose is not to critique those cases; rather, its purpose is to offer concise coverage and review. Overall, the court issued its most significant opinions in the areas of First and Second Amendment issues and § 1983 claims, where immunity frequently was at issue and precluded liability.
