Abstract

In this op-ed, Arnold Loewy and Brian Shannon debate the insanity defense. While Arnold Loewy takes the position that Insanity should not be a complete defense, Brian Shannon argues that the insanity defense should be retained. As Shannon explains, the defense is rarely invoked and seldom successful. Shannon also points out that those not guilty by reason of insanity do not go free.
