Abstract
This article discusses the case of Humber v. Morton and whether builder-vendors of new housing impliedly warrant good workmanship and human habitability. The Texas Supreme Court held that builder-vendors do impliedly warrant good workmanship and habitability and that consumers may base a lawsuit on this theory. Further, this article analyzes the unanswered questions remaining after Humber v. Morton.
