Abstract

Criminal discovery began changing across the country and Texas provided the procedures necessary to make criminal discovery meaningful. This article discusses the changing environment of criminal procedure and suggests future goals for the criminal discovery process. It specifically addresses three discovery procedures: deposition, motion for discovery, and the pretrial hearing. The article concludes with the idea that the long-range goal should be to provide a system for administering justice in which both the defendant and the state are afforded procedures that provide the maximum opportunity, consistent with constitutional safeguards, for obtaining information and evidence for use in criminal cases.
