Abstract

Argues that the constructional problems created by the legalization of same-sex marriage in some states will work themselves out through litigation or legislation in the years to come. Additionally, addresses the challenges and legal pitfalls for married same-sex couples in the states that do not recognize such a union. These challenges include estate planning difficulties, dissolution problems, drafting considerations for other legal documents, planning for children from a same-sex marriage and more.
