Abstract

This comment informs the reader about new legislation from the 78th Regular Session related to Municipal Setting Designations. It provides historical background, statutory analysis, accompanied by legislative history, and commentary by individuals on both sides. It is an informational resource and does not advocate a position. It begins by explaining statutory liability for environmental contamination through numerous federal and state statutes, then it addresses House Bill 3152, the bills implementation by the Texas Commission on Environmental Quality (TCEQ), and current city actions. Finally, it states opinions of local attorneys and politicians about the new bill and its implementation.
