Introduces a survey of the United States Court of Appeals for the Fifth Circuit’s environmental law cases. The author provides a brief description of the cases contained in the survey for the period from September 1, 1974, through August 31, 1975. The author notes that the court again took progressive environmental positions which often resulted in its disagreeing with other circuits. These disagreements, particularly the ones involving interpretations of the Federal Clean Air Act, produce an unsettled state of law which ultimately must be resolved by the United States Supreme Court.
