Abstract

Analyses the varying ways in which states classify personal injury awards as community or separate property. First, the article compares the different states classification of these recoveries, and how that affects contributory negligence, interspousal immunity, and contribution. Next, the article provides “a suggested analysis for each of these problem areas[,] and a detailed examination of the present unresolved problems facing Texas court.”
