Abstract

Summarizes the United States Supreme Court’s decision in Trimble v. Gordon. In Trimble the Court held that an Illinois statute that did not allow illegitimate children to inherit by intestate succession from their father, but allowed legitimate children to inherit from either their mother or their father through intestacy, violated the Constitution’s equal protection clause. The author believes that Texas’s statutes will need to be amended to comply with this ruling when paternity is established by an order.
