Abstract

The purpose of this comment is to present a summary of the status of the criminal offense of forcible rape in the state of Texas. This comment does not attempt to deal with sociological and psychological facets of forcible rape; rather, it is intended to focus upon legal aspects of rape within our criminal justice system, particularly upon courtroom procedures and evidentiary aspects of the offense. However, there will necessarily be an interface with a certain amount of historical and background material, limited sociological data, crime reports, legislative studies, and case law from other jurisdictions in areas not yet confronted by Texas courts. Beyond this, the comment is geared to the practitioner in Texas, and it is hoped that practitioners may find it a useful reference.
