Abstract
Discusses the issue of whether the National Labor Relations Act authorizes the National Labor Relations Board to exercise jurisdiction over lay teachers in parochial schools. The author examines this question by using the test established in McCulloch v. Sociedad Nacional de Marineros de Honduras. The same test that the courts use when the Boards’ exercise of jurisdiction raises serious public questions.
