Abstract

Focuses on the issue of whether the commercial speech doctrine extended first amendment protection to speech communicated in the form of a trade name. The author recites the Court’s holding that minimal showing of a valid interest by a state, the state will be able to regulate commercial speech, particularly when related to health care. The author believes that the Court is anxious to retreat from the unchartered area of First Amendment protection of commercial speech.
