Abstract

Describes the United States Supreme Court’s case Vitek v. Jones. In Vitek, the Court held that the transfer of a prisoner to a mental health hospital, without notice, an adversary hearing, and a written statement of the facts relied on in the decision, violated the prisoner’s fourteenth amendment due process rights. The author believes that more clarification is required for the standard.
