Abstract
Discusses the Fifth Circuit’s decisions regarding the new Bankruptcy Code provisions from the new Bankruptcy Reform Act of 1978. During this survey period there were limited number of cases applying the new Bankruptcy Code provisions. There were also a few cases under the Bankruptcy Act of 1892 that apply the Bankruptcy rules still in effect. The author concludes that changes wrought in bankruptcy procedures by the recently promulgated Bankruptcy Rules and Bankruptcy Reform Act of 1978 prevent pitfalls for the unwary practitioner.
