Abstract
The Fifth Circuit rendered a multitude of labor law decisions during the survey period. The bulk of the decisions served to reaffirm established precedent. This Survey will examine significant decisions concerning sections 3(8) and 6(f) of the Occupational Safety and Health Act (OSHA), statutory deductions under the Social Security and Black Lung Acts, section 7(d)(1) of the Age Discrimination in Employment Act of 1967, an implied right of action under the Davis-Bacon Act, and injunctive relief under the Norris-LaGuardia Act.
