Abstract

Discusses police officer immunity and the common law rule that allows immunity despite the testimony being perjured or malicious. While immunity is necessary for the integrity of the judicial process, the author sees a conflict between witness immunity and the defendant’s right to a constitutional tort claim when a witness gives false testimony.
