Abstract
Surveys cases decided by the Fifth Circuit related to civil procedure from July 1983, through June 1984, not including jurisdictional questions, choice of law issues, or other areas that are covered in a separate article within this volume. Topics include pretrial procedure, including pleadings, discovery, summary judgement, multiple parties and claims, class actions, and shareholder’s derivative suits; trial, including the right to a jury, directed verdict and related procedures, charge of the court, jury deliberations, verdicts, docket control, and sanctions; judgments, including remedies, res judicata, post-trial motions, and settlement agreements; and appellate procedure, including late filing, the effect of post-trial motions, and appealable orders.
