Abstract
This is the first Texas Tech Law Review survey of Civil RICO decisions by the Fifth Circuit Court of Appeals, with special emphasis on questions of arbitrability and matters of procedure. The author asserts that the Fifth Circuit’s decisions did not add meaningfully to development of civil RICO law, and its failure to follow its own precedent in many instances is cause for concern.
