Abstract

Reviews contemporary Fifth Circuit opinions relative to the Federal Rules of Evidence. The author subdivides evidentiary subjects into the following topic areas: marital privilege, impeachment of character witnesses, attorney-client-privilege, admission of business records, expert testimony, jury misconduct, and non-hearsay statements made in the furtherance of a conspiracy. The author finds the majority of these decisions mundane and unremarkable, save the case of United States v. Dotson, in which the court required more than mere participation in the investigation as a precondition for a law enforcement officer’s opinion testimony as to a defendant’s and a defendant’s witness’ disposition toward truthfulness.
