Abstract

Analyzes the Supreme Court case of Price Waterhouse v. Hopkins. The Court held that if the plaintiff can show that an impermissible criterion was an important factor in an employment decision the burden would shift to the employer to show that the same decision would have been made regardless of that criteria. The case helped established the casual requirements in a mixed-motive Title VII claim.
