Abstract

Analyzes the current status of the employment at-will doctrine in Texas and proposes a permanent modification of the doctrine based on an implied standard of good faith and fair dealing. The comment starts by tracing the development of the employment at-will doctrine, and then analyzes how the doctrine has been changed by state and federal statutes and case law. Next it proposes the idea that Texas can protect workers from arbitrary discharge without sacrificing control by implying a standard of good faith and fair dealing in every employment contract.
