Abstract
Reviews the significant environmental law cases decided by the Fifth Circuit during the survey period focusing primarily on Riverside Market Development Corp. v. International Building Products, Inc. The article will also discuss briefly three other opinions: Dayton Independent School District v. U.S. Mineral Products Co., Chevron U.S.A., Inc. v. Yost, and Carr v. Alta Verde Industries, Inc. The Fifth Circuit also decided several other cases in the environmental law area; however, these cases neither break new ground nor address substantive environmental law issues. Therefore, they will not be discussed in this article.
