Abstract

Discusses privacy issues involving consumer credit information in Texas and analyzes the Texas Financial Institutions Privacy Act. Considers both its strengths, when it represents a good faith effort to provide appropriate protection for consumers' financial institutions' records, and weaknesses, when it offers only procedural guidelines and demonstrates a lack of any substantive rights. The author concludes that input from various interested parties needs to be sought and that the final law must strike a balance between the consumers’ privacy rights and the burden imposed on financial institutions complying with additional regulations.
