Abstract

Analyzes the development of general concept of a common law action for invasion of privacy in Texas and explores the Texas Supreme Court holding in Diamond Shamrock Refining & Marketing Co. v. Mendez. The court did not expressly recognize the tort of false light as an actionable tort in Texas, the court acknowledged however that some Texas appellate courts have recognized the tort of false light, and that if the tort does exist, it requires a showing of actual malice.
