Abstract
Examines the rise of “operating agreements” in the joint operation of mineral properties and the correlative upsurge in litigation involving such agreements. These instruments are a complex and highly interrelated web of property provisions which the author asserts have increased flexibility and fiduciary responsibility in the transfer and disposition of property interests.
