Abstract

Proposes that new criteria be developed by Texas courts to determine negligent infliction of emotional distress. The article starts with an overview of mental anguish recovery by discussing the history and development of the tort. The article then discusses the exceptions to the general rule for recovery through case law, proposes guidelines for a new rule, and lobbies for the adoption of a new rule.
