Abstract

Briefly explores the historical development of the unanimous jury verdict and follows with a discussion of the Court’s decision in Apodaca v. Oregon. The court allowed a defendant’s criminal conviction based on a jury verdict that was not unanimous. Also looks at how states can determine what they want to do in respect to jury verdicts.
