Abstract

Discusses the split of authority surrounding the right to a jury trial in bankruptcy courts. The article analyzes how the courts have determined traditionally whether a party has a right to a jury trial, analyzes the Bankruptcy Amendments and Federal Judgeship Act of 1984, discusses the power of bankruptcy courts to conduct jury trials, and attempts to clarify present law. The article ends with a suggestion on how a bankruptcy courts should determine if the right to a jury trial exists and if the bankruptcy court may conduct the jury trial.
