Abstract

Professor Baker discusses the attempts of the United States Supreme Court to determine whether cases have been adequately decided upon independent state grounds. In doing so, Baker critiques the new methodology employed by the Court in Michigan v. Long and the lack of legal justification from which the methodology springs.
