Abstract

Discusses the Texas Supreme Court’s decision in Barker v. Dunham. In Barker, the Court held that if a district court has erroneously denied discovery, a writ of mandamus may issue to compel the district judge to do so. The author predicts that this decision will create a “significant increase in the already overloaded supreme court docket.”
