Abstract
The intent of this comment is to set out an analytical framework for ascertaining, from Texas case law, the existence or non-existence of a confidential fiduciary relationship. This framework is designed to help the practitioner, and the court, not only to identify the confidential relationship, but also to analyze and argue its existence more effectively.
