Abstract

Addresses evidence cases in the fifth circuit during the survey period. The cases dealt with preservation of error, relevancy, witnesses, and hearsay. The author found that the court continues to follow deference to the trial judge on evidentiary rulings. However, cases on expert opinion testimony may signal a need for closer scrutiny by trial judges and the court's decision in United States v. Moody reminds that there is no substitute for consulting the applicable rule of evidence.
