Examines the D’Oench, Duhme doctrine in light of the case, In re Smith. Here the United States District Court for the Northern District of Texas reversed the bankruptcy court, holding that the D’Oench, Duhme doctrine is not a surrogate for proof of actual reliance under the Bankruptcy Code.
