Surveys bankruptcy cases decided by the Fifth Circuit during the survey period. Topics include the limits on the rights of creditors’ committee to intervene in a bankruptcy adversary proceeding, limits on the strong-arm powers of a trustee in bankruptcy over rights created by a state law constructive trust, the standard of review of bankruptcy court’s findings of fact, the effect of confirmation of a debtor’s chapter eleven plan of reorganization on unconditional individual guaranties, and the collateral estoppel effect of state court judgments on bankruptcy dischargeabilty proceedings.
