Abstract

Analyzes a significant gap between technology development and relevant regulation. Part I will briefly discuss the historical struggle between law and technological change. Part II will detail the ongoing confrontation between civil libertarians and governmental officials involved with recent crackdowns on computer users suspected of wrongdoing. Part III will analyze the world of technology and commercial transactions as well as the recent attempts by the Uniform Commercial Code to address the problems presented by the Brave New World. Part IV will dissect Professor Tribe's so-called "Cyberspace Amendment," and call for its adoption.
