Abstract

Describes the Texas Supreme Court’s decision in Williams v. Williams. The Court in Williams held that a party may waiver their constitutional homestead right in a valid premarital agreement. The author believes this case supports the principle in Texas that the court should not impose on the ability of adults to contract.
