Abstract

Examines the United States Supreme Court’s case Monell v. Department of Social Services. The Court held in the instant case that “local governments can be sued directly under section 1983 for damages or equitable relief if the unconstitutional action is pursuant to governmental custom or if it implements or executes an officially adopted policy statement, ordinance, regulation, or decision.” The author believes that this decision is only the beginning of the development of 1983 actions.
