Abstract

Discusses the Fifth Circuit’s decisions concerning admiralty law and the important cases that helped shape the law. The four areas affected were: (1) the recovery of attorney’s fees from a compensation carrier (2) the effect of settlement by one joint-tortfeasor on the judgment rendered against a non-settling tortfeasor (3) deviation in the proper delivery of cargo under the Carriage of Goods by Sea Act and (4) wrongful death under the Jones Act. The Admiralty section of this symposium will review the significant cases in these four areas.
