Abstract
Discusses the possibility of applying principles of liability for bad faith claims to medical malpractice suits. The author recognizes the “medical malpractice crisis” and the need for such a cause of action, and provides a theoretical avenue to achieve equal judicial access. This proposal will afford full protection to the patient, the patient’s attorney, and the physician.
