Abstract

Discusses the Supreme Court case, City of Newport v. Fact Concerts, Inc. In this case the City of Newport was found guilty of denying Fact Concerts their constitutional right to free speech and due process. Fact Concerts sought both compensatory and punitive damages against the city of Newport. Eventually, the Supreme Court held that a municipality was immune from punitive damages under 42 U.S.C. § 1983.
