Abstract
Injuries and deaths from crowds are very common in the United States and around the world. Plaintiffs choosing to pursue damages often litigate under negligence claims because little statutory law exists for crowd crushing. This article discusses analytical errors made in determining crowd crush cases, why these decisions are in conflict with crowd science, and offers suggestions to improve the jurisprudence of crowd crush cases.
