Abstract
During the survey period, the Fifth Circuit Court of Appeals decided three intellectual property cases of interest. The first, a copyright case, may become a landmark on the enforceability of mass marketed software licenses. In the second case, the Fifth Circuit clarified the law in the area of idea submission. In the third case, in which the federal government asserted title to a patent, the court decided whether laches could bar stale claims by the federal government.
