The article identifies and analyzes inconsistencies in three fundamental areas, including the scope of the jury’s decision-making power, the competence of the jury to decide, and the trustworthiness of the jury’s verdict. The article discusses what these inconsistencies tend to show about jury practice in Texas civil cases.
