Abstract

Examines the United States Supreme Court’s case E.I. DuPont de Nemours & Co. v. Train. In this case the Court held that under the Federal Water Pollution Control Act Amendments of 1972, the Environmental Protection Agency has the authority to implement maximum levels of lawful pollutant discharge—effluent limitations. The author wonders whether Congress will stand behind these pursuits or fold under industry pressure.
