Abstract

Mark Train once wrote, “There are three kinds of lies: lies, damned lies, and statistics.” Professor Baker uses the spirit of this statement to investigate the long-voiced claim that U.S. federal appellate courts are overworked and approaching critical mass. He takes a critical eye to the numbers presented by the Federal Courts Study Committee and then provides an alternative analysis with a somewhat rosier outlook.
