Abstract
The paper explores the paradox of firearm dispossession amidst legal and practical contradictions. It examines how existing laws struggle to reconcile the removal of firearms from individuals deemed a risk while maintaining constitutional rights. The analysis highlights the systemic conflicts between enforcement agencies’ mandates and judicial interpretations that create an untenable situation. Through case studies and legal precedents, the paper illustrates the operational difficulties and inconsistencies that arise. Ultimately, it proposes a framework for resolving these conflicts to ensure both public safety and legal coherence.
