dc.description.abstract | This article attempts to set out those aspects of jury selection that are common to most federal district courts: The method of composing the venire, the judge's administration of challenges for cause, and limitations on voir dire examination by attorneys and the court. This article will also discuss the various ways in which courts administer voir dire, the empanelment of jurors, and the allocation of peremptory strikes in multiparty litigation. The discussion of the empanelment of jurors encompasses consideration of the effects of recent changes to the Federal Rules of Civil Procedure. The article also explores tactics employed by attorneys in the use of voir dire and peremptory challenges. Finally, this article covers an aspect of federal civil jury selection that the United States Supreme Court only recently made uniform: the application of constitutional limitations on the use of peremptory strikes. The article discusses the application of the principles of Batson v. Kentucky in the civil context, and considers the scope of Batson challenges in federal civil litigation. | en_US |
