Abstract
This comment provides a comprehensive overview about the Texas Department of Criminal Justice—Institutional Division and how they operate and discipline inmates. It covers how the TDCJ-ID balances prison rules, statutory rules, and constitutional standards. It addresses what happens when an inmate violates TDCJ-ID rules, what disciplinary procedures are used, sanctions that are assessed, how prisoners have challenged sanctions and disciplinary proceedings under Double Jeopardy and Due Process claims, and how TDCJ-ID has avoided claims through their rules. Finally, it discusses the exhaustion of administrative remedies requirement for a writ of habeas corpus.
