Abstract

Arnold Loewy and Charles Moster debate whether a President should use a litmus test to choose his nominee for Supreme Court justice. In chemistry, a litmus test determines if a substance is acidic or alkaline. Metaphorically, as used here, it would determine exactly how a judicial candidate stands on one particular issue. Moster is a former litigation attorney in the Ronald Reagan and George H.W. Bush presidential administrations who currently has offices in Lubbock and Amarillo, and Arnold is the George Killiam Professor of Law at Texas Tech School of Law.
