Abstract

Beginning in 1970, Texas courts began expressing dissatisfaction with the Lord Mansfield’s Rule. Explains how the rule affects the common law, acquiring property, legitimizing children, and spousal testimony to prove non-access. The author cites recent court decisions that have given clear and needed leadership in the area of testimony on non-access. However, the author notes that the recent decisions leave many unanswered questions.
